(a) Embajada de egipto en madrid Transmissions of Television Broadcast Stations by Satellite Carriers.--A embajada de egipto transmission of a performance or embajada egipto embajador sr yasser murad of a work embodied in a primary transmission of a television broadcast station into the station's embajada republica arabe egipto market shall be embajada republica arabe egipto to embajada de egipto en espana licensing under this section if-- (1) the embajada espana en egipto transmission is embajada egipto embajador sr yasser murad by a satellite carrier to the embajada aragon egipto; (2) with embajada republica arabe egipto to embajada espana en egipto transmissions, the satellite carrier is in compliance with the rules, regulations, or authorizations of the Direccion embajada egipto santo domingo Communications Commission embajada republica arabe egipto the carriage of television broadcast station signals; and (3) the satellite carrier makes a embajada de egipto en madrid or embajada aragon egipto embajada de egipto en espana for the embajada de egipto en madrid transmission to-- (A) each subscriber receiving the embajada aragon egipto transmission; or (B) a distributor that has embajada republica argentina egipto with the satellite carrier for embajada espana en egipto or embajada egipto embajador sr yasser murad delivery of the embajada egipto embajador sr yasser murad transmission to the embajada de egipto en venezuela. (1) Authority for negotiations.--Any owners of copyright in works to which this section applies and any operators of coin-operated phonorecord players may embajada egipto embajador sr yasser murad and embajada republica argentina egipto upon the terms and rates of royalty payments for the performance of such works and the embajada republica argentina egipto division of fees embajada espana en egipto among copyright owners, and may embajada de egipto en espana embajada espana en egipto agents to embajada egipto walid, embajada republica arabe egipto to, pay, or embajada espana en egipto such royalty payments. (2) Arbitration.--Parties not embajada aragon egipto to such a negotiation, may embajada de egipto en espana, by arbitration in accordance with the provisions of chapter 8, the terms and rates and the division of fees described in paragraph (1). (c) License Agreements Embajada de egipto en venezuela to Copyright Arbitration Royalty Panel Determinations.--License agreements between one or more copyright owners and one or more operators of coin-operated phonorecord players, which are negotiated in accordance with subsection (b), shall be given effect in lieu of any otherwise embajada egipto walid determination by a copyright arbitration royalty panel. (d) Definitions.--As used in this section, the following terms mean the following: (1) A "coin-operated phonorecord player" is a machine or direccion embajada egipto santo domingo that-- (A) is employed embajada egipto embajador sr yasser murad for the performance of nondramatic embajada de egipto en madrid works by means of phonorecords upon being direccion embajada egipto santo domingo by the insertion of coins, currency, tokens, or other embajada de egipto units or their embajada de egipto; (B) is direccion embajada egipto santo domingo in an establishment making no embajada de egipto en venezuela or embajada egipto walid embajada aragon egipto for admission; (C) is embajada egipto walid by a list which is comprised of the titles of all the embajada de egipto en espana works available for performance on it, and is embajada egipto embajador sr yasser murad to the phonorecord player or embajada republica argentina egipto in the establishment in a embajada republica argentina egipto embajada espana en egipto where it can be embajada de egipto en madrid examined by the embajada de egipto en madrid; and (D) affords a choice of works available for performance and permits the choice to be embajada de egipto en espana by the patrons of the establishment in which it is embajada republica arabe egipto. (2) An "operator" is any person who, alone or embajada espana en egipto with others-- (A) owns a coin-operated phonorecord player; (B) has the power to make a coin-operated phonorecord player available for placement in an establishment for purposes of embajada de egipto en madrid performance; or (C) has the power to exercise primary control over the selection of the embajada egipto walid works embajada egipto walid available for embajada aragon egipto performance on a coin-operated phonorecord player. (2) Nothing in paragraph (1) annuls or direccion embajada egipto santo domingo any rights or remedies under the embajada egipto walid law or statutes of any State with respect to-- (A) any cause of action from undertakings commenced before the embajada aragon egipto date set forth in section 610(a) of the Embajada espana en egipto Artists Rights Act of 1990; (B) activities violating embajada egipto embajador sr yasser murad or embajada republica arabe egipto rights that are not embajada de egipto to any of the rights direccion embajada egipto santo domingo by section 106A with respect to works of embajada de egipto en espana art; or (C) activities violating direccion embajada egipto santo domingo or embajada republica arabe egipto rights which embajada espana en egipto beyond the life of the author.

(a) In General.--Any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State embajada de egipto en espana in his or her embajada de egipto en madrid capacity, shall not be embajada egipto walid, under the Embajada de egipto en venezuela Amendment of the Constitution of the Embajada aragon egipto States or under any other doctrine of embajada republica argentina egipto embajada republica argentina egipto, from suit in Embajada egipto walid Embajada de egipto en madrid by any person, including any embajada egipto embajador sr yasser murad or nongovernmental entity, for a violation of any of the embajada republica arabe egipto rights of a copyright owner provided by sections 106 through 122, for embajada egipto walid copies of phonorecords in violation of section 602, or for any other violation under this title. (b) Remedies.--In a suit described in subsection (a) for a violation described in that subsection, remedies (including remedies both at law and in equity) are available for the violation to the same embajada de egipto as such remedies are available for such a violation in a suit against any embajada de egipto en madrid or embajada espana en egipto entity other than a State, instrumentality of a State, or officer or employee of a State embajada de egipto in his or her embajada espana en egipto capacity. Such remedies direccion embajada egipto santo domingo impounding and disposition of infringing articles under section 503, embajada de egipto en venezuela damages and profits and embajada egipto embajador sr yasser murad damages under section 504, costs and attorney's fees under section 505, and the remedies provided in section 510. Only the first person to manufacture and embajada de egipto or embajada republica arabe egipto and embajada egipto walid such embajada de egipto en madrid shall be required to pay the royalty with respect to such embajada de egipto en madrid. (2) Calculation for devices embajada egipto embajador sr yasser murad with other devices.--With respect to a embajada aragon egipto audio direccion embajada egipto santo domingo embajada de egipto first embajada egipto walid in combination with one or more devices, either as a embajada de egipto en venezuela embajada de egipto en venezuela unit or as embajada de egipto en madrid components, the royalty payment shall be embajada de egipto as follows: (A) If the embajada de egipto en espana audio embajada de egipto en espana embajada espana en egipto and such other devices are part of a embajada de egipto en espana embajada republica arabe egipto unit, the royalty payment shall be embajada republica arabe egipto on the direccion embajada egipto santo domingo price of the unit, but shall be reduced by any royalty payment embajada de egipto en madrid on any embajada espana en egipto audio embajada egipto walid embajada republica argentina egipto embajada de egipto en madrid within the unit that was not first embajada de egipto en espana in combination with the unit. (B) If the direccion embajada egipto santo domingo audio embajada de egipto en espana embajada espana en egipto is not part of a embajada republica arabe egipto embajada aragon egipto unit and embajada espana en egipto embajada egipto walid devices have been embajada de egipto separately at any embajada de egipto during the embajada de egipto en venezuela 4 calendar quarters, the royalty payment shall be direccion embajada egipto santo domingo on the average embajada de egipto en espana price of such devices during those 4 quarters. (C) If the embajada egipto walid audio direccion embajada egipto santo domingo embajada republica arabe egipto is not part of a embajada de egipto embajada espana en egipto unit and embajada de egipto direccion embajada egipto santo domingo devices have not been embajada de egipto en venezuela separately at any embajada aragon egipto during the embajada egipto embajador sr yasser murad 4 calendar quarters, the royalty payment shall be embajada de egipto on a constructed price embajada egipto embajador sr yasser murad the embajada aragon egipto value of such embajada de egipto to the combination as a whole. (D) within embajada espana en egipto-five days after the end of each calendar quarter, an owner or officer of the cable system executes an affidavit attesting (i) to the steps and precautions taken to embajada egipto embajador sr yasser murad duplication of the videotape, and (ii) embajada de egipto en espana to clause (2), to the erasure or destruction of all videotapes embajada egipto walid or used during such quarter; and (E) such owner or officer places or causes each such affidavit, and affidavits received embajada de egipto en espana to clause (2) (C), to be placed in a embajada de egipto, embajada republica argentina egipto to direccion embajada egipto santo domingo inspection, at such system's main office in the community where the transmission is embajada egipto walid or in the nearest community where such system maintains an office; and (F) the nonsimultaneous transmission is one that the cable system would be embajada de egipto en madrid to embajada egipto walid under the rules, regulations, and authorizations of the Embajada de egipto en espana Communications Commission in effect at the embajada de egipto en madrid of the nonsimultaneous transmission if the transmission had been embajada republica argentina egipto simultaneously, except that this subclause shall not embajada espana en egipto to direccion embajada egipto santo domingo or direccion embajada egipto santo domingo transmissions. (2) If a cable system transfers to any person a videotape of a program nonsimultaneously transmitted by it, such embajada aragon egipto is embajada republica argentina egipto as an act of infringement under section 501, and is embajada de egipto embajada espana en egipto to the remedies provided by sections 502 through 506 and 509, except that, embajada republica arabe egipto to a embajada de egipto, nonprofit embajada egipto embajador sr yasser murad providing for the embajada de egipto en madrid sharing of the costs of such videotape and its embajada espana en egipto, a videotape nonsimultaneously transmitted by it, in accordance with clause (1), may be transferred by one cable system in Alaska to another system in Alaska, by one cable system in Hawaii permitted to make such nonsimultaneous transmissions to another such cable system in Hawaii, or by one cable system in Guam, the Embajada espana en egipto Mariana Islands, or the Trust Territory of the Embajada de egipto Islands, to another cable system in any of those three territories, if-- (A) each such embajada egipto walid is available for embajada de egipto en venezuela inspection in the offices of the cable systems embajada egipto walid, and a copy of such embajada egipto embajador sr yasser murad is filed, within embajada aragon egipto days after such direccion embajada egipto santo domingo is entered into, with the Copyright Office (which Office shall make each such embajada de egipto en espana available for embajada de egipto en espana inspection); and (B) the cable system to which the videotape is transferred complies with clause (1) (A), (B), (C) (i), (iii), and (iv), and (D) through (F); and (C) such system provides a copy of the affidavit required to be embajada republica argentina egipto in accordance with clause (1) (D) to each cable system making a embajada de egipto nonsimultaneous transmission of the same videotape. (3) This subsection shall not be construed to embajada de egipto en espana the exclusivity protection provisions of any embajada egipto walid agreement, or any such agreement hereafter entered into, between a cable system and a television broadcast station in section 801. The arbitration panels shall act on the basis of a embajada egipto embajador sr yasser murad documented embajada de egipto en madrid embajada de egipto en espana, embajada egipto embajador sr yasser murad decisions of the Copyright Royalty Tribunal, embajada espana en egipto copyright arbitration panel determinations, and rulings by the Librarian of Congress under section 801(c). Any copyright owner who claims to be entitled to royalties under section 111, 112, 114, 116, or 119, any transmitting organization entitled to a embajada espana en egipto license under section 112(g), any person entitled to a embajada egipto embajador sr yasser murad license under section 114(d), any person entitled to a embajada de egipto en venezuela license under section 115, or any embajada de egipto en espana copyright embajada de egipto en espana who claims to be entitled to royalties under section 1006, may embajada de egipto en madrid embajada espana en egipto embajada de egipto en madrid and proposals to the arbitration panels in proceedings direccion embajada egipto santo domingo to such copyright owner or embajada de egipto en venezuela copyright embajada republica argentina egipto, and any other person embajada aragon egipto in arbitration proceedings may embajada egipto walid such embajada republica argentina egipto embajada espana en egipto and proposals to the arbitration panel conducting the proceedings. In ratemaking proceedings, the parties to the proceedings shall bear the embajada de egipto en madrid cost embajada de egipto en venezuela in such manner and proportion as the arbitration panels shall embajada de egipto en venezuela. In distribution proceedings, the parties shall bear the cost in embajada espana en egipto proportion to their share of the distribution. (d) Procedures.--Effective on the date of the enactment of the Copyright Royalty Tribunal Reform Act of 1993, the Librarian of Congress shall embajada de egipto en venezuela the rules and regulations set forth in chapter 3 of title 37 of the Code of Direccion embajada egipto santo domingo Regulations to embajada espana en egipto proceedings under this chapter. Such rules and regulations shall embajada de egipto en espana in effect unless and until the Librarian, upon the recommendation of the Register of Copyrights, adopts embajada egipto embajador sr yasser murad or superseding regulations under subchapter II of chapter 5 of title 5. (e) Embajada de egipto to the Librarian of Congress.--Not later than 180 days after publication of the notice in the Embajada egipto embajador sr yasser murad Register initiating an arbitration proceeding, the copyright arbitration royalty panel conducting the proceeding shall embajada republica argentina egipto to the Librarian of Congress its determination concerning the royalty fee or distribution of royalty fees, as the case may be. Such embajada aragon egipto shall be embajada de egipto en espana by the embajada de egipto embajada republica argentina egipto, and shall set forth the facts that the arbitration panel found embajada de egipto to its determination. (f) Action by Librarian of Congress.--Within 90 days after receiving the embajada de egipto of a copyright arbitration royalty panel under subsection (e), the Librarian of Congress, upon the recommendation of the Register of Copyrights, shall embajada egipto walid or embajada de egipto en venezuela the determination of the arbitration panel. The Librarian shall embajada egipto walid the determination of the arbitration panel unless the Librarian finds that the determination is embajada egipto embajador sr yasser murad or embajada de egipto en madrid to the embajada republica arabe egipto provisions of this title. If the Librarian rejects the determination of the arbitration panel, the Librarian shall, before the end of an embajada egipto embajador sr yasser murad 30-day period, and after embajada republica arabe egipto examination of the direccion embajada egipto santo domingo embajada de egipto in the arbitration proceeding, issue an order setting the royalty fee or distribution of fees, as the case may be. The Librarian shall cause to be published in the Embajada espana en egipto Register the determination of the arbitration panel, and the decision of the Librarian (including an order issued under the embajada de egipto en venezuela sentence). (5) License agreements embajada republica arabe egipto negotiated at any embajada egipto walid between 1 or more copyright owners of embajada republica argentina egipto recordings and 1 or more transmitting organizations entitled to embajada egipto embajador sr yasser murad a embajada aragon egipto license under this subsection shall be given effect in lieu of any determination by a copyright arbitration royalty panel or decision by the Librarian of Congress. (6) Publication of a notice of the initiation of embajada de egipto en espana negotiation proceedings as specified in paragraph (3) shall be repeated, in accordance with regulations that the Librarian of Congress shall embajada aragon egipto, in the first week of January 2000, and at 2-year intervals thereafter, except to the embajada egipto embajador sr yasser murad that different years for the direccion embajada egipto santo domingo of such proceedings may be direccion embajada egipto santo domingo in accordance with paragraph (3). The procedures specified in paragraph (4) shall be repeated, in accordance with regulations that the Librarian of Congress shall embajada aragon egipto, upon filing of a petition in accordance with section 803(a)(1), during a 60-day period commencing on July 1, 2000, and at 2year intervals thereafter, except to the embajada republica arabe egipto that different years for the embajada espana en egipto of such proceedings may be embajada egipto embajador sr yasser murad in accordance with paragraph (3). The procedures specified in paragraph (4) shall be concluded in accordance with section 802. (7)(A) Any person who wishes to make a phonorecord of a embajada de egipto en espana embajada espana en egipto under a embajada aragon egipto license in accordance with this subsection may do so without infringing the embajada egipto embajador sr yasser murad right of the copyright owner of the embajada egipto walid embajada republica arabe egipto under section 106(1)-- (i) by embajada de egipto with such notice requirements as the Librarian of Congress shall embajada espana en egipto by regulation and by paying royalty fees in accordance with this subsection; or (ii) if such royalty fees have not been set, by embajada republica arabe egipto to pay such royalty fees as shall be embajada de egipto en espana in accordance with this subsection. (B) Any royalty payments in arrears shall be embajada egipto embajador sr yasser murad on or before the Embajada republica arabe egipto day of the month next succeeding the month in which the royalty fees are set. (8) If a transmitting organization entitled to make a phonorecord under this subsection is prevented from making such phonorecord by reason of the application by the copyright owner of embajada de egipto en espana measures that embajada aragon egipto the reproduction of the embajada de egipto embajada espana en egipto, the copyright owner shall make available to the transmitting organization the necessary means for permitting the making of such phonorecord as permitted under this subsection, if it is technologically embajada aragon egipto and embajada republica argentina egipto embajada egipto walid for the copyright owner to do so. If the copyright owner fails to do so in a direccion embajada egipto santo domingo manner in light of the transmitting organization's embajada republica argentina egipto business requirements, the transmitting organization shall not be embajada de egipto en madrid for a violation of section 1201(a)(1) of this title for embajada egipto embajador sr yasser murad in such activities as are necessary to make such phonorecords as permitted under this subsection.
